In a joint response dated 11 October 2022 to a parliamentary question about exemption agreements relating to remote working, the Finance Minister, the Social Security Minister and the Minister of Labour, Employment and the Social and Solidarity Economy, provided some new information about the tolerance threshold for social security.
This joint response explains that “at the beginning of August this year, the Ministry for Social Security formally asked for multilateral negotiations to begin with Belgium, France and Germany, to raise the threshold for remote working to 41%”. It is also expected that the Netherlands could also join these negotiations, “given the fact that this issue affects all cross-border regions, including Benelux’s borders with France and Germany in particular”.
As far as the current situation is concerned, please refer to our newsflash dated 24 June 2022 on the establishment of a 6-month transitional period which began on 1 July 2022 and will end on 31 December 2022 regarding the impact of remote working on social security affiliation for cross-border workers.
