Bill on the postponement of trade union elections

Bill No. 7138 amending 1. the amended law of 4 April 1924 on the establishment of professional chambers with an elective basis and 2. the Labour Code (hereinafter “the Bill”) was tabled by the Minister of Labour, Employment and the Social Solidarity Economy in the Chamber of Deputies on 17 May 2017.

The Bill is intended to move the next elections for the Chamber of Employees, originally scheduled for November 2018, to a date in February or March 2019 to be fixed through Grand-Ducal regulation.

The purpose of this postponement is to prevent elections for the Chamber of Employees from being prepared during the electoral period of the legislative elections to be held in October 2018. It is also proposed that this election take place over a two-month period in order to prevent a school holiday period from disrupting the conduct of the electoral process.

In order to ensure the principle of coordination of all trade union elections is maintained, the Bill also intends to postpone elections for staff delegates during the same period.

In this context, in order to avoid any legal vacuum, the Bill provides for the extension of the terms of office of members of the Chamber of Employees, staff delegates, salaried members of the joint work council, members of the body representing a European company, members of the body representing a European cooperative society and employee assessors in the labour courts, until the newly elected members take office.
